I really hate to quote a post from the first page in a somewhat-inactive thread, but is this how Ken's Super Duper Band N' Stuff came about?

I know it has negative connotations, but it also has rocking connotations as far as I can tell.
Dig it!

Thanks for the dig, RG and BLT! After a few days of thinking, I will probably take TRASH over TRA$H - despite the possible legal problems inherent to such a simple, common name.

Life can be so unfair at time. Just when you think you're at the top of the heap, BAM, you're at the bottom of the can.
I say we all pitch in a buck and buy "TRASH" off those PA douche bags for $27.50 and a 12 pack of Pabst Blue Ribbon. We can give it to Reist as an early bar mitzvah gift. Who's in?

How notable does a band have to be before you can get in trouble for picking the same name? If a couple of the fourteen-year-old boys down the street start messing around on Garageband and making crappy loop-based rap, call themselves Trash, and register a Myspace page, does that make a name off-limits?

Obviously, if someone out there tried becoming famous with the name Brad Sucks, he wouldn't get far because of... well, yeah. But if someone out there tried becoming famous with the name Rone Rivendale, would Mike Bush be able to stop them? Probably not. So where's the line?

Just saying... There's a lot of bad groups out there with great names and no futures.

Notability is probably irrelevant.

Those dudes got the .../trash Myspace page - which I suppose if important if you want to be fair dinkum about things

I can tell you it is annoying. The guy who owns octothorpe.com has been just sitting on it for years. There have several myspace/octothorpe users over the years. I never seem to notice when they go away, before another one pops up to take their place. Just saying, it's better if it's free and clear.

Yeah, this is problematic. I've checked around a few times, and it looks like most bands called Trash suck, and could easily be stolen from. However, I don't really want to get sued. And as far as I can tell, a lot of people thrive on lawsuits, so I'd rather not provoke anyone.

Anybody got ideas along the theme of Trash? I've come up with some names relating to Trash, Waste or Garbage, but I can't really come up with anything that sounds as cool as Trash.

For the record, you can call your band anything you want as long as there isn't another band in the same market. This of course means you can't call yourself Steely Dan because they are big enough to have broke into your market. However, if you call yourself Trash and there is no band selling anything in your local market you can use it.

http://www.alankorn.com/articles/band_trademark.html

The problem only comes when you AND the another band are big enough to threaten each other's market. BUT, there will only be a lawsuit if both of you don't want to give up the name. In other words, the worst case scenario is that you will receive a cease and desist letter long before there would be any ACTUAL lawsuit. Then you can just ad 182 to the end of your name at that point.
