Despite dying in 1999, I am appalled by your band, Phunt your Friends. Your use of the word Phunt sullies my good name. Years ago, the name Funt was synonymous with hilarious hidden camera hijinks and practical jokes. Now it describes avantgarde indie experiment noise music that I just don't understand. Perhaps you should've moved to do the same to them? Definitely contact MySpace, though. This is bull. They should've mediated before this.
There are no grounds for this. And MySpace shouldn't just delete an account based on some singular complaint.

Agreed. I'm pissed off, but wtf ever. We still have our stuff up here. I was really suprised that the account was deleted without and previous contact from myspace at all. I really don't feel much like fighting I guess. They must have felt pretty damn threatened by us if they took such drastic measures to "get rid" of us. The whole thing is total bullshit. Grrrr!

MySpace's "customer support" sucks huge ass. I uploaded "We Are All Famous" ... uh, let's see ... not sure... a year ago? And it never showed up on the page. So I sent a help message... two months or so went by until they sent me an automated email to tell me how to upload a song. Which I had done already - obviously they hadn't actually read my message, I'm amazed these people even were able to get their attention. Blech. I guess I'm just saying don't expect much from "support".

Seeing as the Evil Hell Yeahs have gone this route, why don't you cut them off at the pass.
The laws they cited in their original message to you are copyright laws and as we already know, you can copyright songs but not bandnames. Bandnames are trademarked. The Evil Hell Yeahs don't own the trademark on the bandname "The Hell Yeahs". There is a t-shirt company by the name "Hell Yeah" but that wouldn't be a conflict. Instead of doing a sidefight to rag on the Evil Hell Yeahs, how about a fundraiser of some sort to help the Good Hell Yeahs pay for getting the trademark for the bandname as well as the servicemark. The Good Hell Yeahs don't really need to have the Servicemark but if they get it- the other Hell Yeahs couldn't perform under the name either. Altogether, it costs about 500 bucks for both.
