Yep!
The full name is "Giana 2: Hard n Heavy." The lawsuit was because Giana 1 (official title: The Great Giana Sisters) was a shameless parody of Super Mario Bros., and Nintendo used that as grounds to claim that the (vastly different) mechanics of Giana 2 were also copyright-infringing. They didn't have a case but the company which put out the Giana series was something like two guys in a basement with no operating capital.

Sorry, I didn't realize this game was called "name that old game obscurity has seen screenshots of." Could you provide a list so that we know which games are safe to use?
Giana 2 didn't officially ship but that didn't stop it from becoming notorious and well-spread (the lawsuit only made it MORE popular, which is all it could havehoped for since frankly, Giana 1 sucked, and Nintendo had every right to get it pulled from the shelves). Pretty much everyone in the c64 disk-swapping (and later emulation) scenes had copies of both of them.

So, is there a general consensus that it's OK to look up games you have no clue about and then post the answers anyway?
There were a couple of times where I found the games posted but didn't give answers because I kinda felt like I was cheating.
But I sure as hell knew Custer's, though. Dropped the ball on that one.
